The text next to the consent checkbox must include all CTIA-mandated elements.

Compliance Checklist:
- Enrollment for text messaging opt in or opt out or stop
- Message Purpose: Clearly state opt in or opt out or stop message option will be displayed and complied with.
- Message Frequency: “Message frequency varies” or give a specific number (1 Up to 12 mgs. per year, twelve month period).
- Pricing Disclosure: “Message and data rates may apply.”
- Opt-Out Instructions: “Reply STOP to cancel”.
- Help Instructions: “Reply HELP for help”.

The dedicated T&C page linked in the opt-in form must include an “SMS Communications” section containing:
- Opt-Out: Instructions on how to opt-out, You can cancel the SMS service at any time. Just text ‘STOP’ to the short code or Toll-Free number. After you send the SMS message ‘STOP’ to us, we will send you an SMS message to confirm that you have been unsubscribed.

- Carrier Liability Disclaimer: “Carriers are not liable for delayed or undelivered messages.”
- Cost and Frequency: “Message and data rates may apply” and the message frequency.
- Privacy Policy Validations
Carrier verification processes are currently highly stringent regarding data sharing. Our Privacy Policy is clearly stated to protect our Toll-Free carrier, service providers, at a zero liability, zero tolerance for any actions or non-actions.
- No Third-Party Sharing for Marketing: Our privacy policy does not permit nor allow any mobile information and SMS opt-in sharing with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties unless required by law.
- We do not share any contact information with trusted marketing partners.
- Back end System (Audit Trail) Validations
Each carrier maintains the right to audit any consumer complaint under the TCPA. Our back end system maintains a secured record of the following when the user clicks “Submit”:
- Timestamp: The exact date and time the form was submitted.
- IP Address: The IP address of the user who submitted the form.
- Page URL: The exact URL where the consent was collected.
- Consent Version: Our T&C and Privacy Policy the user agreed to at that time of enrollment consent.
